International Custody

A recent case will have an impact on the courts’  view of international custody arrangements.  In Burger v. Smith, the two parents met, married, and began to raise their child in Malawi.  The child’s mother, now living in NC, was concerned about the current visitation schedule due to health risks the child would face visiting his father in Malawi.  The custody order was affirmed, giving the father discretion to exercise visitation in Malawi during spring, summer, and Christmas breaks.
