Father’s Rights

It has long been assumed that the mother of a child is automatically assumed to be the most fit parent for the children. This is not so in the world today. We are finally moving into a progressive age in which men are treated equally in the family law world.

Fathers have the same right to their children as do mothers. Fathers have rights to custody, visitation, and to argue against a mothers’ right to custody and visitation. When a child is first born, there is a presumption that the child needs to be with their mother for nutrition and bonding purposes. This presumption could last up to a year however, it can be rebutted. If there is a reason that the mother is unfit to be a mother the court can order the child to remain in the physical and legal custody of the father.
