Bobber v. Bobber – Date of Separation
In order to dispute the date of separation, Husband claimed to be “fraudulently coerced” into signing a separation agreement saying the parties had been separated on 2/25/13. Wife filed for divorce on 2/27/13, based on the date of separation. Divorce was granted. The parties’ testimony about Husband’s brief stay with Wife upon return from military assignments in order to “remain cordial for the kids” was not found to change the date of separation for purposes of the divorce decree.
